No Jail Time for Driver in Pedestrian Death

A 27-year-old driver who pleaded guilty to failing to stop at the scene of an accident that resulted in the death of a 90-year-old pedestrian will not serve jail time.

Justin Kenneth Nicholls was sentenced to a nine-month conditional sentence to be served in the community by Judge Tamara Hodge in Provincial Court in Nanaimo.

The sentence was handed down after Nicholls pleaded guilty to failing to stop at the scene of an accident that killed 90-year-old Bertha Abma in February 2024.
