No Jail Time for Driver in Pedestrian Death
A 27-year-old driver who pleaded guilty to failing to stop at the scene of an accident that resulted in the death of a 90-year-old pedestrian will not serve jail time.
Justin Kenneth Nicholls was sentenced to a nine-month conditional sentence to be served in the community by Judge Tamara Hodge in Provincial Court in Nanaimo.
- First six months: house arrest with exceptions for work and errands
- Final three months: curfew
- Prohibited from possessing drugs or alcohol and entering licenced premises
- Must complete community service work by spring
The sentence was handed down after Nicholls pleaded guilty to failing to stop at the scene of an accident that killed 90-year-old Bertha Abma in February 2024.
